Settlement reached in July 4th parade death

BANGOR, Maine (NEWS CENTER) -- The widow of a man killed in a 4th of July parade three years ago has settled her lawsuit against the city and the group who put on the parade.

Wallace Fenlason from Holden was riding a tractor in the Bangor parade put on by the Kiwanis Club in 2013. The brakes on a Bangor fire truck behind him stopped working and he was crushed to death.

An investigation showed there was insufficient brake fluid in the truck and the Kiwanis club violated a 25-foot distance rule between floats.

Fenlason's wife, Lorena, sued the city of Bangor and the Kiwanis club. The case was settled for an undisclosed amount last week.

Fenlason's attorney said the Fenlason family is happy about the turnout.

“The Fenlason family is grateful that they had this opportunity to find out why Wally's death happened. We know that no one in the City of Bangor or Kiwanis wanted this to happen, but sometimes mistakes happen, and the responsible thing to do is go back and find out why they happened, make it right and make sure that it never happens again. We feel that's what this lawsuit accomplished,” said Attorney Daniel Kagan of Berman and Simmons in Lewiston.

The City of Bangor and the Kiwanis Club did not want to comment.
