Attorney says DFCS needs change from top down

An attorney for Emani Moss' grandmother said he will take whatever action necessary to force DFCS to make changes.

LOGANVILLE, Ga -- It wasn't until after 10-year-old Emani Moss died that her grandmother finally got custody of her. Robin Moss tried for years to keep her granddaughter away from her father and step-mother.

On Wednesday a probate court judge in Gwinnett County made Moss temporary administrator of the girl's estate.

Moss' son Emani Moss and his wife Tiffany Moss were charged with Emani's murder after her burned body was found in a trash can Saturday.

Loganville attorney Mike Jones, who represents Robin Moss, said he wants changes made at the Department of Family and Child Services (DFCS) after the state agency agreed to put the 10-year-old girl back into her step-mother's custody after she plead guilty to beating her in 2010.

"She (step-mother) is on probation for five years for child abuse of that child and they place her back there anyway," Jones said. "Somebody needs to answer to that."

Jones said DFCS needs to be held accountable. "We're going to figure out a way to make it happen, if it takes a lawsuit or whatever it takes", he said. "I want to see every scrap of paper that has this child's name on it."

Jones said he will file papers in court to keep DFACS from destroying any documents, recordings or anything related to Emani's case.
